State-Specific Notes

Distinction from Direct Appeal:
A reconsideration motion under § 902.4 is a request for the sentencing court to exercise its discretion, not an appellate review. Direct appeals are taken to the Iowa Court of Appeals. Post-conviction relief under Iowa Rule of Criminal Procedure 2.24 addresses constitutional violations.

Court's Own Motion or DOC Recommendation:
Under § 902.4, the court may act on its own motion or on the recommendation of the Director of the Iowa Department of Corrections. Defense counsel may request that the DOC Director make such a recommendation.

Hearing Not Required:
The court may, but is not required to, conduct a hearing upon request of the state, defense counsel, or the defendant. The statute leaves this to the court's discretion.

Class "A" Felony Exclusion:
Reconsideration under § 902.4 is not available for Class "A" felonies (e.g., first-degree murder), which carry a mandatory sentence of life without parole.

Mandatory Minimum Exclusion:
Offenses carrying a mandatory minimum sentence of confinement are excluded from reconsideration under § 902.4. Practitioners must verify whether the defendant's offense includes a mandatory minimum.

Retroactive Sentencing Changes:
Iowa has enacted various criminal justice reforms. Defendants should evaluate whether any retroactive changes to sentencing law apply. Recent amendments to Iowa Code chapters 901 and 902 should be reviewed.

Reopening of Sentence:
Iowa Code § 901.5A provides a separate mechanism for reopening a sentence that contains an error. This is distinct from the broader reconsideration available under § 902.4.

About This Template

Criminal law paperwork covers every stage of a criminal case, from the first appearance and bail motion through pretrial motions, plea agreements, sentencing, and appeals. Deadlines in criminal cases are short and often unforgiving, and constitutional rights can be waived just by missing a filing. Using the right motion at the right time can mean the difference between evidence getting suppressed, charges getting reduced, or a case getting dismissed entirely.

Important Notice

This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
