I. INTRODUCTION
Defendant [DEFENDANT NAME], by and through undersigned counsel, respectfully moves this Court for admission to the [NAME OF JURISDICTION] Veterans Treatment Court ("VTC") as an alternative to traditional prosecution and incarceration. Defendant is a veteran of the United States Armed Forces whose charged conduct is causally linked to service-connected post-traumatic stress disorder ("PTSD"), traumatic brain injury ("TBI"), military sexual trauma ("MST"), and/or substance use disorder ("SUD") arising from honorable military service.
The Veterans Treatment Court model was created in January 2008 by the Honorable Robert T. Russell, Jr. in Buffalo, New York, in response to a growing population of justice-involved veterans presenting with service-connected mental-health and substance-use conditions on his drug and mental-health court dockets. The model has since expanded to 600+ VTCs nationwide and is supported by the U.S. Department of Veterans Affairs through its Veterans Justice Outreach ("VJO") Program, which assigns specialists to coordinate VA treatment, benefits, and case management for justice-involved veterans.
Defendant is eligible, willing, and clinically appropriate for VTC supervision, will be coordinated by a VA VJO specialist, and will be supported by a volunteer veteran mentor. Admission will serve public safety, reduce recidivism, and honor the Court's interest in rehabilitating those whose criminal conduct is a consequence of their service to the Nation.

B. State-Specific Statutory Pathways
California
- Pen. Code § 1001.80 — Pretrial military diversion for misdemeanors and felonies not excluded by subdivision (o); successful completion results in dismissal and arrest "deemed never to have occurred."
- Pen. Code § 1170.9 — Post-conviction: court shall make a pre-sentence determination of veteran status and service-connected condition; if defendant is probation-eligible, court shall consider the service-connected condition as a factor in favor of probation and may order treatment in lieu of jail/prison.
- Pen. Code § 1170.91 — Service-connected trauma is a mitigating circumstance the court must consider in selecting the lower term.
- Restorative Relief under § 1170.9(h): public hearing on 15 days' notice; if defendant in substantial compliance and successfully participated in treatment, court may order early termination, set aside conviction, and dismiss accusatory pleading.

- Programs integrate substance-abuse / mental-health treatment, frequent testing, judicial interaction, and partnerships with VA.

- Fla. Stat. § 394.47891 — T. Patt Maney Veterans' Treatment Intervention Act; authorizes statewide VTC programs administering both misdemeanors and felonies; admission application to State Attorney; chief judge and state attorney have exclusive authority over dishonorably discharged participants.
- Fla. Stat. § 948.16 — Misdemeanor pretrial substance-abuse / veterans intervention program; successful completion results in dismissal.
