A. Earned Furlough Privileges (N.J.A.C. 10A:20-4.35)

Inmates enrolled in the Residential Community Reintegration Program (RCRP) may earn furlough privileges:

Prohibition: No furlough in the 30-day period prior to maximum release date per N.J.A.C. 10A:20-4.35(e).

B. Compassionate Release (N.J.S.A. 30:4-123.51e)

The Superior Court may grant compassionate release when an inmate has a terminal or grave medical condition certified by two physicians and a Certificate of Eligibility has been issued.

C. Work Release (N.J.S.A. 30:8-44)

The court may authorize outside labor or vocational training for county inmates.

D. Statutory Prohibitions (N.J.S.A. 30:4-91.3b)

The following offenders are prohibited from participating in furlough programs:
- Murder (N.J.S.2C:11-3)
- Manslaughter (N.J.S.2C:11-4)
- Sexual Assault (N.J.S.2C:14-2)
- Robbery (N.J.S.2C:15-1)

10. NEW JERSEY PRACTICE NOTES

1. Earned Furlough Through RCRP: Furlough privileges in New Jersey are primarily earned through enrollment in the Residential Community Reintegration Program (RCRP). Inmates must be within specific timing windows relative to their maximum release date.

2. Timing Windows:
   - 12-hour furloughs: 365 to 181 days before max release
   - 24-hour furloughs: 180 to 30 days before max release
   - No furloughs in the final 30 days before max release

3. Statutory Prohibitions: Under N.J.S.A. 30:4-91.3b, inmates convicted of murder, manslaughter, sexual assault, robbery, kidnapping, or aggravated assault are categorically prohibited from furlough programs.
