3. RELEASE BY SURETY BOND

Ohio Law: A property owner may discharge a mechanics' lien by posting a surety bond with the county recorder. The bond amount must be:
- Double (200%) the lien claim amount, OR

8. PRACTITIONER NOTES
Key Considerations for Ohio Mechanics' Lien Releases
A. 60-Day Filing Deadline Is Critical
Ohio requires the Affidavit for Mechanic's Lien to be filed within 60 days after completion of the improvement or the last furnishing of labor or materials (ORC 1311.06). When evaluating a lien for release, first verify whether the lien was timely filed. A lien filed beyond the 60-day window is invalid and subject to discharge on that ground alone.
B. Notice to Commence Suit — Primary Owner Remedy
The ORC 1311.11 Notice to Commence Suit is the primary tool for Ohio property owners to force resolution. After proper service, the lien claimant has exactly 60 days to file suit. If no suit is filed, the lien is void by operation of law. This is a powerful, frequently used remedy.
C. Bond Amounts — Tiered System
Ohio's bond requirements use a tiered system:
- Claims of $5,000 or less: Bond must be double (200%) the claim
- Claims exceeding $5,000: Bond must be 150% of the claim
This tiered approach makes bonding more affordable for larger claims, which are more common in commercial construction.
D. Court of Common Pleas Jurisdiction
All mechanics' lien matters, including bond approval and lien discharge, are within the exclusive jurisdiction of the Court of Common Pleas in the county where the property is located. Municipal courts and county courts lack jurisdiction over lien matters.
E. Notice of Commencement and Notice of Furnishing
Ohio's lien system relies on a Notice of Commencement (filed by the owner, ORC 1311.04) and Notice of Furnishing (filed by subcontractors, ORC 1311.05). When releasing a lien, verify whether these notices were properly served, as failure to comply may invalidate the lien and provide grounds for discharge.
F. Six-Year Foreclosure Period
Ohio has one of the longer foreclosure deadlines in the country — six years from the date the affidavit was filed (ORC 1311.13). This means a lien can encumber property for up to six years unless discharged by bond, notice to commence suit, or court order. For property owners, the Notice to Commence Suit (Section 4) is the most efficient way to force earlier resolution.
G. Residential vs. Commercial Projects
Ohio's mechanics' lien law applies to both residential and commercial projects, but with different notice requirements. The Notice of Commencement is particularly important for residential projects, as failure to file it may limit the owner's ability to assert certain defenses.
H. Title Insurance Considerations
Ohio title companies require a recorded Release and Satisfaction of Mechanic's Lien to remove the lien exception. If the lien has been voided by failure to respond to a Notice to Commence Suit, a court order confirming the void status may be required by the title company before removing the exception.
