IMPORTANT NEW MEXICO NOTE: New Mexico records mechanics' liens with the County Clerk. The bond-discharge procedure under NMSA 48-2-10 requires a petition to the district court, which examines the lien and sets the bond amount. Upon bond filing, the court immediately orders cancellation of the lien, and the county clerk must cancel it. The lien then attaches to the bonding company and is enforceable against the surety.

New Mexico-Specific Considerations
Court-Supervised Bond Process:
New Mexico's bond discharge procedure under NMSA 48-2-10 is unique in that it requires the district court to examine the lien claimant's demands and determine the bond amount. This is not a simple ministerial filing -- the court exercises discretion in setting the bond. The advantage is that the court can assess the validity of the claim and set an appropriate amount. The disadvantage is the need for a court proceeding.
Immediate Cancellation:
Once the bond is filed, the court must immediately issue an order canceling the lien and notify the county clerk. The county clerk then cancels the lien. This is a fast and definitive process once the court sets the bond.
Lien Attaches to Surety:
Under NMSA 48-2-10, the lien transfers from the property to the bonding company and is enforceable against the surety in the same district court. The lien claimant retains all the same enforcement rights against the surety as they had against the property.
"Agent of Owner" Concept:
New Mexico uses the concept of "agent of owner" under NMSA 48-2-2 to determine who is entitled to file a lien. This is broader than some states and includes contractors, subcontractors, and materialmen who furnish labor or materials at the direction of or with the consent of the owner. If the claimant does not qualify as an "agent of owner," the lien may be invalid.
Two-Year Enforcement Period:
New Mexico provides a relatively generous two-year enforcement period under NMSA 48-2-7. This means liens can encumber property for up to two years before expiring. Property owners who need to clear title sooner should use the bond procedure.
120-Day Filing Deadline:
The claim of lien must be filed within 120 days after completion of the work or the last furnishing of labor or materials. If this deadline was missed, the underlying lien is invalid.
33-County System:
New Mexico has 33 counties. File the release with the same County Clerk where the original lien was recorded.
Contractor Licensing:
New Mexico requires contractor licensing through the Construction Industries Division (CID) of the Regulation and Licensing Department. An unlicensed contractor may face challenges enforcing a mechanics' lien. Verify the claimant's license status when evaluating a lien's validity.
Community Property State:
New Mexico is a community property state. When the property subject to the lien is community property, both spouses may need to be considered in lien enforcement and release proceedings.
