A.1 Recipients

Every preliminary notice on a private work of improvement must be served on all three of the following (Civ. Code § 8200(a)):

  1. The owner or reputed owner.
  2. The direct (general) contractor or reputed direct contractor.
  3. The construction lender, if any (or reputed construction lender).

Exceptions (Civ. Code § 8200(e)):

  • A laborer is not required to give preliminary notice.
  • A claimant with a direct contractual relationship with the owner must give preliminary notice only to the construction lender (if any).

A.3 Service Method (Civ. Code §§ 8106, 8110, 8114, 8118)

Service is effected by any of:

  • Personal delivery.
  • Leaving the notice with a person in charge at the recipient's residence or place of business AND mailing first-class mail to that address.
  • Mailing by first-class mail, registered or certified mail, or express mail, evidenced by certificate of mailing.

Service is complete on deposit in the mail (Civ. Code § 8116).

Retain (i) the original signed proof of service / certificate of mailing, (ii) the green return-receipt card or USPS tracking confirmation, and (iii) a true copy of the notice as served. Lost proof is the most common reason preliminary notices fail in court.

A.4 Deadline Calculation

  • "First furnishing" = first day actual labor performed or materials/equipment delivered to the jobsite, NOT the date of the contract or purchase order.
  • Count calendar days. If day 20 falls on a Saturday, Sunday, or holiday, the deadline rolls to the next court day (Civ. Code § 8116; Code Civ. Proc. § 12).
  • Late notice is not fatal, but the lien is limited to work / materials supplied within the 20-day window preceding service plus all later work (Civ. Code § 8204(a)).

VIII. Statutory "Notice of Mechanics Lien" Required by Civ. Code § 8416(a)(8)

Part C — Notice of Filing Lien Claim to Owner

In California, the proof-of-service affidavit attached to the recorded lien (Part B.X) satisfies the post-recording notice obligation. There is no separate post-recording notice statute (contrast Florida § 713.08(4)(c) which requires a 15-day post-recording delivery). However, claimants frequently send a courtesy cover letter to the owner enclosing the recorded lien with recording-data stamp:
