Life Estate Deed (Reserved Life Estate) - California

California Real Estate Updated October 29, 2026 Free Word and PDF

IMPORTANT LEGAL NOTICE
This is a TRADITIONAL RESERVED LIFE ESTATE GRANT DEED. The Grantor grants the remainder to the Remainderman while RESERVING a life estate for the named measuring life under Cal. Civ. Code §§ 761, 765, 767, and 769. The Life Tenant keeps use and possession during the life estate (Civ. Code § 818). When that estate ends, the remainder already conveyed becomes possessory without a further deed from the Life Tenant. Once delivered, this deed creates a present remainder and cannot be revoked by the Life Tenant alone.

THIS IS NOT A "LADY BIRD" / ENHANCED LIFE ESTATE DEED.
California does not recognize the Florida-style enhanced life estate ("Lady Bird") deed; California estate planners ordinarily use a revocable living trust to retain control and avoid probate. In this traditional reserved life estate, the Life Tenant CANNOT sell, mortgage, gift, or revoke the fee without the Remainderman joining. Major decisions (sale, refinance) require the consent of both the Life Tenant and the Remainderman. If you want to retain unilateral control during life, use a revocable living trust instead — not this deed.

CONVEYANCE

Granting Clause (Grant Deed — Civ. Code § 1092 — Reserving a Life Estate)

FOR A VALUABLE CONSIDERATION, consisting of love and affection and other good and valuable consideration, receipt of which is hereby acknowledged,

[GRANTOR NAME] ("Grantor")

hereby GRANTS to

[REMAINDERMAN NAME] ("Remainderman")

the remainder in fee simple in all that real property situated in the City of [CITY], County of [COUNTY], State of California, more particularly described in Exhibit A attached hereto and incorporated herein by this reference (the "Property"), together with all improvements, tenements, hereditaments, easements, and appurtenances thereto belonging,

RESERVING, HOWEVER, unto [the Grantor / [LIFE TENANT NAME]] ("Life Tenant"), a life estate in the Property for the life of [NAME OF MEASURING LIFE], with the remainder conveyed above to take possession when that life estate ends (Cal. Civ. Code §§ 761, 765, 767, 769).

Assessor's Parcel Number (APN): [________________________________]

RESERVATION OF LIFE ESTATE (Civ. Code § 818)

Rights of the Life Tenant. During the measuring life, the Life Tenant shall have the exclusive right to use, occupy, possess, and enjoy the Property in the same manner as the owner of a fee simple (Cal. Civ. Code § 818), and to receive all rents, issues, and profits therefrom.

Obligations of the Life Tenant. During the life estate, the Life Tenant shall:

☐ Pay all real property taxes and special assessments as they come due;
☐ Maintain homeowner's/hazard insurance naming the Remainderman as an additional insured to the extent of the Remainderman's interest;
☐ Pay ordinary maintenance and repairs and keep the Property in good condition;
☐ Pay interest on, and keep current, any mortgage or lien existing on the date of this deed.

Duty Not to Commit Waste (Civ. Code § 818). The owner of a life estate may use the land in the same manner as the owner of a fee simple, except that he or she must do no act to the injury of the inheritance. The Life Tenant shall not commit, suffer, or permit waste (voluntary, permissive, or ameliorative) and shall act as an ordinarily prudent owner. The Remainderman may inspect the Property and sue for waste if the value of the remainder is impaired.

REMAINDER / VESTING

Upon the death of [NAME OF MEASURING LIFE], the reserved life estate shall terminate. The Remainderman's interest conveyed by this deed shall then become possessory without a further conveyance from the Life Tenant.

If a Remainderman predeceases the Life Tenant:
☐ The deceased Remainderman's share shall pass to that Remainderman's issue, by right of representation (vested remainder, descendible).
☐ The deceased Remainderman's share shall pass to the surviving Remainderman(en) (joint tenancy with right of survivorship among the Remaindermen).

LIMITATIONS (TRADITIONAL — CONTRAST LADY BIRD)

This is a traditional irrevocable reserved life estate. Accordingly:

  • The Life Tenant cannot sell, convey, mortgage, encumber, partition, or otherwise transfer the fee in the Property without the Remainderman joining in the instrument.
  • The Life Tenant may transfer only the Life Tenant's own life-estate interest (which ends at the measuring life's death).
  • The Remainderman holds a present, vested remainder that is not defeated by any act of the Life Tenant alone.
  • The Grantor reserves no power to revoke, cancel, or unilaterally convey the fee. (Such a retained power would create an enhanced/"Lady Bird" deed — which California does not recognize and which this instrument is NOT.)

WARRANTY / IMPLIED COVENANTS (Civ. Code § 1113)

The remainder conveyed herein is conveyed by grant deed. The use of the word "grant" implies the two statutory covenants of Cal. Civ. Code § 1113 (that the Grantor has not previously conveyed the same estate, and that the estate is free from encumbrances done or suffered by the Grantor), unless restrained by the express terms hereof. (Alternatively, select a quitclaim of the remainder: ☐ Grantor conveys the remainder without warranty of title.)

EXCEPTIONS / SUBJECT TO

This conveyance is made and accepted SUBJECT TO:

☐ General and special real property taxes and assessments for the current fiscal year, a lien not yet due and payable
☐ Covenants, conditions, restrictions, reservations, rights-of-way, and easements of record
☐ Any matters an accurate survey or inspection would disclose; applicable zoning and land-use ordinances
☐ Any existing deed of trust of record (confirm any due-on-transfer clause before recording)
☐ Other: [________________________________]

TAX, MEDI-CAL / MEDICAID, PROP 19, AND ESTATE-PLANNING NOTE

Proposition 19 reassessment (Cal. Const. art. XIII A, § 2.1). Creating a reserved life estate where the Grantor remains the life tenant generally is not a change of ownership until the life tenant's death (beneficial use does not pass until then). At that point, the transfer to the Remainderman is a change of ownership; the parent-child exclusion is now sharply limited by Prop 19 — it applies only to a primary residence the child uses as the child's own primary residence (with a value cap), and the former $1 million exclusion for other real estate is eliminated. File a Preliminary Change of Ownership Report and confirm Prop 19 treatment with the county assessor.

Medi-Cal long-term care. California uses a 30-month transfer look-back, with a phased review period after asset limits returned in 2026. DHCS excludes transfers made from January 1, 2024, through December 31, 2025, from that review. A transfer on or after January 1, 2026, of a nonexempt interest for less than its value may affect payment for nursing-facility-level care, subject to the applicable review period, exceptions, and hardship review. Have the transferred interest and timing assessed before recording this deed.

Estate inclusion and basis (IRC §§ 2036 and 1014). If the Grantor retains possession or enjoyment of the transferred property for life, IRC § 2036 generally includes the affected interest in the Grantor's gross estate at the Grantor's death, except for a qualifying bona fide sale for adequate and full consideration. A life estate granted to someone other than the Grantor does not by itself establish that the Grantor retained an interest under § 2036. IRC § 1014 separately governs whether the Remainderman receives a basis adjustment when the property passes from a decedent; have tax counsel assess the deed and the parties' actual interests.

Gift tax (Form 709). A remainder conveyed without full consideration may be a reportable gift. For a transfer to family in which the Grantor retains a life interest, IRC § 2702 can treat a nonqualified retained interest as having zero value; the ordinary actuarial remainder value is not always the taxable-gift value. Section 2702 has exceptions, including a qualifying personal-residence trust transfer. Have tax counsel determine whether § 2702 applies, whether an exception applies, and the amount and reporting treatment before filing Form 709.

Real estate documents transfer ownership, define who can use a property, and record agreements between buyers, sellers, landlords, and tenants. Deeds, purchase agreements, leases, and easements have to be drafted to meet state recording requirements, and mistakes show up at closing or years later in title disputes. Good real estate paperwork moves transactions forward quickly and avoids the kind of problems that only surface when it is time to sell or refinance.
