Posting: If no one is available, post the notice in a conspicuous place on the dwelling (typically the front door).
-
Mail: Mail the notice via first class mail (and certified mail for important notices) to the tenant's last known address.
Best Practice: Use multiple service methods simultaneously to ensure proper notice and create a clear record.
Documentation Requirements
-
Keep copies of all notices served.
-
Complete the Certificate of Service for each notice.
-
Retain certified mail receipts and return receipt cards.
-
Photograph posted notices with a timestamp.
-
Document all communication with tenants regarding notices.
Timing Considerations
-
Count days carefully - Missouri follows standard calendar day counting.
-
Do not count the day of service when calculating notice periods.
-
Consider mail delivery time when sending notices by mail.
-
Weekends and holidays are generally counted, but if a deadline falls on a weekend or holiday, it typically extends to the next business day.
Important Warnings
☐ Do not attempt self-help eviction. Missouri law prohibits landlords from changing locks, removing doors/windows, shutting off utilities, or removing tenant property without going through proper legal channels.
☐ Do not accept rent after issuing termination notice without understanding that this may waive the notice or create a new tenancy.
☐ Retaliation is prohibited. Do not issue notices in retaliation for tenant complaints to government agencies, exercise of legal rights, or participation in tenant organizations.
☐ Discrimination is prohibited. Notices must not be issued based on protected characteristics under federal, state, or local fair housing laws.
☐ Consult an attorney before proceeding with eviction if the tenant disputes the notice or if complex issues arise.
