| New Monthly Rent | $[________________________________] |
| Rent Increase Amount | $[________________________________] |
| Percentage Increase | [____]% |
| Effective Date | [__/__/____] |
NOTICE PERIOD:
☐ Month-to-Month Tenancy: This notice is being provided at least thirty (30) days before the proposed effective date and before the applicable periodic rental date. This uses the § 35-9A-441(b) termination period as a conservative practice interval; the lease and enforceability of the proposed modification must still be reviewed.
☐ Week-to-Week Tenancy: This notice is being provided at least seven (7) days before the proposed effective date, using the § 35-9A-441(a) termination period as a conservative practice interval.
☐ Fixed-Term Lease: The current lease expressly permits this increase, or the increase will take effect only under a signed modification or after the fixed term ends. Do not unilaterally alter rent during a fixed term unless the lease and law permit it.
ACCEPTANCE:
The proposed increase is subject to the rental agreement and applicable law. Obtain written acknowledgment when possible; do not rely solely on continued occupancy to establish an enforceable mid-term modification.
This increase may not be imposed discriminatorily in retaliation for protected complaints or tenant-organizing activity. Ala. Code § 35-9A-501.
DECLINING THE INCREASE:
If you do not wish to pay the increased rent, you must provide written notice of your intent to terminate your tenancy in accordance with the notice requirements of your rental agreement and Alabama law.

ALABAMA LANDLORD-TENANT LAW QUICK REFERENCE
Key Notice Periods:
| Notice Type | Time Required | Statute |
|---|---|---|
| Pay Rent or Quit | 7 business days | Ala. Code § 35-9A-421 |
| Cure Lease Violation | 7 business days | Ala. Code § 35-9A-421 |
| Terminate Week-to-Week | 7 days | Ala. Code § 35-9A-441 |
| Terminate Month-to-Month | 30 days | Ala. Code § 35-9A-441 |
| Landlord Entry | 2 days | Ala. Code § 35-9A-303 |
| Security Deposit Return | 60 days | Ala. Code § 35-9A-201 |
Security Deposit Rules:
- Maximum Amount: One month's periodic rent, except additional security may be demanded for pets, tenant-requested changes to the premises, or increased liability risks
- Return Deadline: 60 days after termination and delivery of possession
- Itemization Required: Yes, written itemized statement required
- Allowable Deductions: Accrued rent and damages suffered because of the tenant's noncompliance with Ala. Code § 35-9A-301, with amounts withheld itemized in writing
Delivery and Proof:
Ala. Code § 35-9A-144 supplies general notice rules but expressly states that those rules do not apply to notice required to terminate a tenancy or evict a tenant. Do not treat the lawsuit-service alternatives in § 35-9A-461(c) as automatic pre-suit notice methods. Use a method authorized by the rental agreement and current law that can prove receipt where § 35-9A-421 measures the deadline from receipt; obtain Alabama legal review before relying on posting, substitute delivery, or mail alone.

About This Template
Real estate documents transfer ownership, define who can use a property, and record agreements between buyers, sellers, landlords, and tenants. Deeds, purchase agreements, leases, and easements have to be drafted to meet state recording requirements, and mistakes show up at closing or years later in title disputes. Good real estate paperwork moves transactions forward quickly and avoids the kind of problems that only surface when it is time to sell or refinance.
Important Notice
This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
