FLORIDA HOMESTEAD DECLARATION
CRITICAL FLORIDA HOMESTEAD NOTICES — READ FIRST
A. Constitutional Protection Is UNLIMITED in Dollar Value
Florida homestead protection from forced sale by creditors is unlimited in monetary value under Fla. Const. art. X, § 4(a)(1). Unlike most states (which cap homestead at a fixed dollar amount), Florida protects the entire equity in a qualifying homestead, regardless of value. Multimillion-dollar homes are fully protected against most unsecured creditors.
B. Acreage Limits Are STRICT
The homestead exemption is bounded only by acreage, not value:

Improvements (residence, outbuildings) on the protected acreage are included. Excess acreage is not protected and may be subject to forced sale (see Fla. Stat. §§ 222.03–222.04 — survey procedure).
C. FEDERAL BAPCPA CAP — THE 1,215-DAY TRAP
WARNING — Bankruptcy filers: Notwithstanding Florida's unlimited constitutional homestead, 11 U.S.C. § 522(p) imposes a federal cap of $214,000 (current as of the April 1, 2025 inflation adjustment; verify current figure at filing) on the homestead exemption a debtor may claim if the debtor acquired the interest in the homestead within 1,215 days (approximately 3 years and 4 months) before the bankruptcy petition date. The Florida Constitution does not override this federal cap in bankruptcy.
Additionally, 11 U.S.C. § 522(b)(3)(A) requires 730 days of domicile in Florida (or the greater portion of the prior 180 days before that) before a debtor may claim Florida exemptions in bankruptcy. New residents may be forced to claim the exemptions of their prior state.

- Obligations contracted for house, field, or other labor performed on the property
- IRS tax liens (federal supremacy)
- Criminal restitution liens and certain federal forfeitures
- Equitable liens for fraudulently obtained funds traced into the homestead
