|---|---|---|---|---|---|---|---|

Complete a separate row before every contemplated event.

8. Incapacity and Death Response Plan
This section records coordination steps; it does not authorize possession or transfer.
| Trigger | Person responsible to contact counsel | Immediate no-access / preservation step | Federal contact / form review | California contact / form review | Probate / trust / dealer coordination |
|---|---|---|---|---|---|
| Settlor incapacity | [____] | [____] | [____] | [____] | [____] |

Executor, successor trustee, dealer, insurer, and counsel contact sheet location: [________________]
Alternative disposition if a proposed recipient or route is unavailable: [________________]
Do not insert a universal deadline, family-transfer exemption, tax-free estate form, or surrender instruction. Counsel must select the current route for the specific asset and facts.

| Estate / tax review | [________________] | [________________] | [________________] |
| Client and trustee review | [________________] | [________________] | [________________] |
| Signature / witness / notary | [________________] | [________________] | [________________] |
| Initial funding | [________________] | [________________] | [________________] |
| Federal submission / approval | [________________] | [________________] | [________________] |

| Secure records completed | [________________] | [________________] | [________________] |
| Post-approval possession / access change | [________________] | [________________] | [________________] |
The trust’s execution date, an attached asset schedule, or a private assignment does not by itself establish regulatory approval or authorize an event.
11. Ongoing Review Calendar

Final Counsel Checklist
☐ Every asset has a current federal and California classification from official sources.
☐ Current ownership, registration, permits, exemptions, possession, storage, and configuration are documented.
☐ Every proposed trustee, beneficiary, possessor, transporter, recipient, and responsible person has an event-specific review.
☐ The trust design fits the client’s objective and does not purport to legalize prohibited conduct.
☐ No asset is treated as funded by Schedule A, amendment, assignment, or execution alone.
☐ No categorical table of California-legal or prohibited NFA items remains.
☐ No automatic Form 1, Form 4, Form 5, transport authorization, family exemption, dealer route, FSC, fingerprint, photograph, or age instruction remains.
☐ Incapacity and death procedures preserve the status quo until current counsel clearance.
☐ Complete serial numbers, access information, and registration records are stored securely.
☐ The actual trust, agency forms, transfer records, and approvals—not this packet—will control.
☐ Unused options and drafting notes were deleted.
About This Template
Estate planning documents decide what happens to your property, your children, and your medical care when you cannot make those decisions yourself. Wills, trusts, powers of attorney, and health care directives each serve different purposes and each have to meet state law requirements for signing, witnessing, and notarization. A document that looks fine on the page but was not executed correctly can be rejected in probate, which is exactly when it is too late to fix.
Important Notice
