9.2 Service of Process
Service of the Notice is governed by NMSA § 47-8-13. Service of the Summons is governed by Rule 2-202 NMRA and may be made by sheriff, constable, or a person at least eighteen (18) years of age who is not a party.
9.3 Rental Assistance and Emergency Declarations
The 2021 amendments (HB 111) prohibit termination during a declared emergency or disaster. If federal, state, or local rental assistance is pending or has been credited, the rent ledger must reflect those payments before the Notice is served.
