CRITICAL — SOUTH DAKOTA'S UNIQUE COMPARATIVE FAULT SYSTEM: South Dakota is the only state in the nation that uses a slight/gross negligence comparative fault standard (SDCL § 20-9-2). Under this system, a plaintiff may recover only if the plaintiff's contributory negligence was "slight" in comparison with the defendant's negligence, which must be "gross." South Dakota case law generally treats negligence of 10-20% as "slight" and negligence of 30% or more as potentially barring recovery. C. South Dakota's Slight/Gross Comparative Fault (SDCL § 20-9-2)
South Dakota's comparative fault system is unique in the nation:
"Contributory negligence shall not bar a recovery when the contributory negligence of the plaintiff was slight in comparison with the negligence of the defendant, but in such case the damages shall be reduced in proportion to the amount of plaintiff's contributory negligence." — SDCL § 20-9-2

- The plaintiff's negligence must be "slight" in comparison with the defendant's
- The defendant's negligence must be "gross" in comparison with the plaintiff's
