This letter is a timely written notice that I dispute the validity of the alleged debt referenced above and request that you cease all collection activity and provide written verification of the alleged debt pursuant to the federal Fair Debt Collection Practices Act, 15 U.S.C. § 1692g(b).
This letter is sent within thirty (30) days of your initial communication and operates as my formal written dispute. Until you obtain verification and mail it to me, you must cease collection of the alleged debt.
6. SPECIFIC INFORMATION REQUESTED
To validate the alleged debt under § 1692g(b), Regulation F (12 C.F.R. § 1006.34), and applicable Delaware law, please provide each of the following items:
- ☐ The full name and current mailing address of the original creditor;
- ☐ A copy of the original signed agreement, contract, application, or other instrument creating the alleged debt;
- ☐ A complete and itemized account history showing all charges, fees, interest, payments, and credits from the date of opening through the present, including the itemization date and the amount on that date as required by 12 C.F.R. § 1006.34(c)(2);
- ☐ A copy of every assignment or sale of the alleged debt, together with the chain of title from the original creditor to the present collector, and the consideration paid for each transfer;
- ☐ Documentation that you have authority (whether by ownership or written assignment) to collect this alleged debt from me;
- ☐ A copy of your Delaware mercantile/collection agency business license under 30 Del. C. § 2301(a)(11), or a statement explaining the basis on which you claim exemption;
- ☐ The name and Delaware bar number of the attorney supervising any collection activity directed at me, if any communication purports to come from or on behalf of an attorney;
- ☐ A statement of any applicable statute of limitations and the date on which it expires;

7. CEASE COMMUNICATION DIRECTIVE (Conditional)

8. PROHIBITED CONTACT
I do not consent to any of the following, and I direct you to refrain from each:

9. RESERVATION OF RIGHTS UNDER DELAWARE LAW
I expressly reserve all rights, claims, and remedies under:
- The Fair Debt Collection Practices Act, 15 U.S.C. § 1692 et seq.;
- The Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq.;
- Regulation F, 12 C.F.R. Part 1006;
- The Delaware Consumer Fraud Act, 6 Del. C. § 2511 et seq., which provides a private cause of action under 6 Del. C. § 2525 for any victim of a deceptive or unfair practice;
- 30 Del. C. § 2301(a)(11), pertaining to mercantile/collection agency licensing;
- Common-law claims for fraud, negligence, defamation, and invasion of privacy.
Conduct that violates any of the foregoing may subject you to actual damages, statutory damages, treble damages where authorized, attorney's fees, and costs.
10. RECORD RETENTION DEMAND
You are hereby placed on notice to preserve all documents, electronically stored information, telephone recordings, dialer logs, account notes, screen prints, training materials, written or verbal scripts, license records, and any other records related to me or the alleged debt. Spoliation of such evidence will be the subject of an adverse-inference instruction in any subsequent litigation.

14. DELAWARE PRACTICE NOTES
- Delaware has no separate state debt collection act. Unlike many states, Delaware does not regulate consumer debt collection through a dedicated statute. State leverage rests on the Delaware Consumer Fraud Act (6 Del. C. §§ 2511-2527) and on collection-agency licensing under 30 Del. C. § 2301(a)(11).
- Mercantile-agency license. 30 Del. C. § 2301(a)(11) defines a "mercantile agency" or "collection agency" to include "every person operating a business of investigation of financial ratings and credit and/or the collection of commercial or consumer accounts for other persons," excluding licensed Delaware attorneys. Annual fee: $75 plus $25 per additional location. License records are searchable on the Division of Revenue website.
- DCFA private right of action. 6 Del. C. § 2525 authorizes a private suit by any victim without prior AG action and preserves common-law remedies.
- 30-day window. § 1692g(b) protections attach only when the dispute is in writing and within thirty days of the consumer's receipt of the initial communication. Send by certified mail to lock in the date.
- Reg F itemization. Since November 30, 2021, validation notices must include the itemization date and the amount on that date (current balance, plus interest, fees, payments, and credits). 12 C.F.R. § 1006.34. A demand for Reg-F-compliant validation is appropriate.
- Time-barred debt. Delaware's general contract limitations period is three (3) years (10 Del. C. § 8106), four (4) years for sales of goods (6 Del. C. § 2-725). Collection on time-barred debt is not unlawful in itself, but threats to sue on a time-barred debt violate § 1692e(2) and § 1692e(5) and the DCFA.
- CRA furnisher dispute. If the alleged debt is reported, also send a direct dispute to the furnisher under 15 U.S.C. § 1681s-2 and disputes to the three nationwide CRAs.
