Consumer UDAP Demand Letter - New Hampshire
New Hampshire Consumer UDAP Demand Letter
Quick-Reference Summary
| Item | New Hampshire Rule |
|---|---|
| UDAP statute | New Hampshire Consumer Protection Act ("CPA"), RSA 358-A (titled "Regulation of Business Practices for Consumer Protection"). |
| Unlawful-practice standard | RSA 358-A:2: "It shall be unlawful for any person to use any unfair method of competition or any unfair or deceptive act or practice in the conduct of any trade or commerce within this state," including the non-exclusive list in RSA 358-A:2, I–XV. Courts are guided by FTC and federal interpretations of § 5(a)(1) of the FTC Act and apply the "rascality" test. |
| Private right of action | Yes — RSA 358-A:10, I: "Any person injured by another's use of any method, act or practice declared unlawful under this chapter may bring an action for damages and for such equitable relief, including an injunction, as the court deems necessary and proper." |
| Pre-suit demand required | No. Unlike Maine and Massachusetts, New Hampshire imposes no mandatory statutory pre-suit demand or cure period. This letter is sent strategically, not as a statutory precondition. |
| Damages available | Actual damages or $1,000, whichever is greater (RSA 358-A:10, I). Mandatory enhancement for willful or knowing violations: the court "shall award as much as 3 times, but not less than 2 times," that amount. Injunctive and equitable relief available; injunctive relief is available to private individuals without bond. |
| Attorney's fees | Mandatory for the prevailing plaintiff — "a prevailing plaintiff shall be awarded the costs of the suit and reasonable attorney's fees, as determined by the court" (RSA 358-A:10, I). |
| Waiver | "Any attempted waiver of the right to the damages set forth in this paragraph shall be void and unenforceable" (RSA 358-A:10, I). |
| Class actions | Yes — RSA 358-A:10-a. A person entitled to sue under RSA 358-A:10 may proceed as a class representative for residents of, or causes of action arising within, New Hampshire. |
| Statute of limitations | Generally three (3) years (RSA 508:4, general personal-action SOL). Confirm accrual and any applicable tolling for the underlying transaction. |

Consumer protection law gives buyers, borrowers, and renters rights against unfair, deceptive, or abusive business practices. Federal and state laws cover debt collection, credit reporting, product warranties, lemon cars, and more, and most of them have strict deadlines to preserve your rights. A well-drafted demand or complaint puts the business on notice, triggers their legal obligations, and often resolves the issue without a lawsuit.
