IV. Damages and Remedies If Not Cured

Consumer will file a parallel complaint with the Mississippi Attorney General's Consumer Protection Division, which has independent authority to:

  • Obtain temporary and permanent injunctions under Miss. Code Ann. § 75-24-9;
  • Obtain restitution under § 75-24-11;
  • Seek civil penalties of up to $10,000 per violation of an injunction under § 75-24-19(1)(a);
  • Pursue revocation of business licenses or certificates under § 75-24-11.

VI. Response Deadline and Method

Respondent must provide a written response within thirty (30) days of receipt of this letter that either:

  1. Affirmatively elects participation in one of the AG-approved informal dispute settlement programs identified in Section III.B (with a proposed schedule and signed agreement to mediate); OR
  2. Tenders a substantive written settlement offer fully resolving Consumer's ascertainable loss.

Respondent's response must be directed to undersigned counsel at the address, email, and telephone number set forth on the letterhead above.

If Respondent fails to respond, or fails to participate in good faith, Consumer will document this exchange as a "reasonable attempt to resolve" under Miss. Code Ann. § 75-24-15(2), and will then, without further notice:

  1. File suit individually (not as a class) under Miss. Code Ann. § 75-24-15;
  2. File a parallel complaint with the Mississippi Attorney General Consumer Protection Division;
  3. Assert common-law claims for fraud, misrepresentation, breach of contract and warranty, with punitive damages under § 11-1-65;
  4. File complaints with the CFPB, FTC, and industry regulators as appropriate.

All rights, claims, defenses, and remedies are expressly reserved. Nothing in this letter constitutes a waiver of any right or remedy under state or federal law.
