III. ALABAMA LAW - INTEREST AND COLLECTION
A. Statutory Interest Rate
Under Alabama Code section 8-8-1, the legal rate of interest in Alabama is 6% per annum. The parties may agree in writing to a rate not exceeding 8%. For amounts over $2,000 in commercial transactions, higher rates may be agreed upon. See Ala. Code section 8-8-5.
B. Statute of Limitations
Under Alabama Code section 6-2-34, actions on written and oral contracts must be brought within six (6) years. This debt is well within the limitations period.
C. Post-Judgment Remedies Available in Alabama
Upon obtaining a judgment, Creditor may pursue:
- Wage Garnishment: Up to 25% of disposable earnings under Alabama and federal law
