FREQUENTLY ASKED QUESTIONS ABOUT OPTING OUT
1. What happens if I opt out?
If you opt out, you will not be part of the Settlement Class. You will not receive any payment from the Settlement, and you will not release any claims against the Defendant. You will keep your right to sue the Defendant on your own.
2. Can I still submit a claim if I opt out?
No. If you opt out, you cannot submit a claim for payment from the Settlement. The deadline to opt out and the deadline to submit a claim are separate.
3. Can I change my mind after I opt out?
Generally, no. Once you submit a valid Request for Exclusion by the deadline, it is final. You should carefully consider your decision before opting out.
4. If I opt out, can I sue the Defendant on my own?
Yes. If you opt out, you retain the right to pursue your own individual lawsuit against the Defendant. However, you will be responsible for your own attorney's fees and costs. You should be aware that:
- There may be statute of limitations issues
- Individual litigation can be expensive and time-consuming
- There is no guarantee of recovery in individual litigation
- You should consult with an attorney before deciding to pursue individual claims
5. If I opt out, will I be bound by the Settlement?
No. If you opt out, you will not be bound by the Settlement Agreement or any judgment in this case. You will not release any claims against the Defendant.
6. Should I opt out?
This is a personal decision that depends on your individual circumstances. Factors to consider include:
- The amount you might receive from the Settlement
- The strength of your individual claims
- The cost of pursuing individual litigation
- The statute of limitations for your claims
- Your willingness to participate in potentially lengthy litigation
We strongly recommend that you consult with an attorney before deciding whether to opt out.
7. Do I need a lawyer to opt out?
No. You do not need a lawyer to opt out. However, you may wish to consult with a lawyer about whether opting out is the right decision for you.
8. What if I do nothing?
If you do nothing, you will remain a member of the Settlement Class. If you want to receive a payment, you must submit a Claim Form by the deadline. If you do not submit a Claim Form, you will not receive a payment, but you will still release your claims against the Defendant.
