Bullying Complaint Letter

Purpose

This template is used by parents, guardians, or students to formally report bullying, harassment, or intimidation at school. All 50 states have anti-bullying laws that require schools to investigate and address bullying. Filing a written complaint creates a record and triggers the school's legal obligation to respond.

What Constitutes Bullying?

Bullying typically involves:

• Repeated harmful behavior (though one severe incident may qualify)
• Imbalance of power between the aggressor and target
• Intent to harm physically, emotionally, or socially

Types of Bullying:

• Physical: Hitting, pushing, taking belongings
• Verbal: Name-calling, threats, insults
• Social/Relational: Exclusion, rumor-spreading, embarrassment
• Cyberbullying: Online harassment, threatening messages, posting harmful content

When Federal Civil Rights Laws Apply

Bullying may also violate federal civil rights laws when based on:

• Race, color, or national origin (Title VI)
• Sex or gender (Title IX)
• Disability (Section 504, ADA, IDEA)
• Religion (First Amendment)

When bullying is based on these protected characteristics, it may constitute illegal harassment.

If Bullying Involves Cyberbullying

Additional steps for cyberbullying:

1. Do not respond to the bully
2. Screenshot everything before it can be deleted
3. Do not delete evidence from your child's devices
4. Report to the platform (Instagram, TikTok, Snapchat, etc.)
5. Block the aggressor on all platforms
6. Report to school even if it occurred off-campus (many states require schools to address off-campus cyberbullying that affects school)
7. Contact police if threats of violence are made

If the School Does Not Respond Adequately

Step 1: Escalate Within the District

Contact the Superintendent and School Board in writing.

Step 2: File a State Complaint

Contact your State Department of Education to file a complaint about the school's failure to comply with state anti-bullying law.

Step 3: File an OCR Complaint (for Civil Rights Violations)

If bullying is based on race, sex, national origin, or disability:
