PERSONAL DECLARATION FOR ASYLUM APPLICATION
PURPOSE
This template provides a framework for preparing a personal declaration (affidavit or statement) to support an asylum application filed on Form I-589. The declaration is the applicant's opportunity to tell their story in their own words and is one of the most critical documents in an asylum case.
IMPORTANT LEGAL STANDARDS
Definition of Refugee (INA § 101(a)(42))
A refugee is a person who is unable or unwilling to return to their country of origin because of:
- Past persecution, OR
- Well-founded fear of future persecution
On account of ONE of the five protected grounds:
- Race
- Religion
- Nationality
- Membership in a particular social group
- Political opinion
Burden of Proof
The applicant must establish:
- Credible testimony (specific, consistent, and plausible)
- Corroborating evidence (where reasonably available)
- A nexus between the persecution and a protected ground
One-Year Filing Deadline
Applications must generally be filed within one year of arrival. Exceptions:
- Changed circumstances materially affecting eligibility
- Extraordinary circumstances relating to delay
- Filed within reasonable period given circumstances

COMMON ISSUES TO AVOID
Credibility Problems

About This Template
Immigration paperwork is federal and unforgiving: one wrong box, one missing document, or one late response can mean a denial, a delay, or loss of status.
