PETITION FOR ANNULMENT (NULLITY) OF MARRIAGE

Before filing: Use this petition only when the facts support a California nullity ground. Select the ground and state the facts that establish it. California Family Code §§ 2200 and 2210 distinguish void and voidable marriages, and § 2211 supplies ground-specific filing periods. The current bulk code also says § 2211 remains in effect only until January 1, 2027; verify the operative text and current Judicial Council forms, filing instructions, service requirements, and local court rules before filing.

  2. Enter a judgment of nullity if the evidence and law support that judgment;
  3. Enter only the child, property, debt, or support orders supported by the pleaded facts and applicable law; and
  4. Grant any other relief the Court may lawfully grant.

Legal authority

  • Cal. Fam. Code § 2200 (incestuous marriages are void)
  • Cal. Fam. Code § 2210 (grounds for a voidable marriage)
  • Cal. Fam. Code § 2211 (time limits for specified nullity grounds)

Family law covers the paperwork that shapes divorce, custody, child support, adoption, guardianship, and other family matters. These filings are emotional and high-stakes, and they also have to meet strict procedural rules for service, financial disclosure, and parenting plans. Clean, accurate paperwork keeps the focus on getting a workable outcome for the family instead of getting derailed by technical problems that delay hearings or force amended filings.
