IMPORTANT LEGAL NOTICE
This Affidavit of Surviving Joint Tenant is a sworn instrument used to clear title after the death of one joint tenant. In Kansas, a grant or devise to two or more persons creates a TENANCY IN COMMON unless the instrument makes clear that a joint tenancy was intended (K.S.A. 58-501); only a joint tenancy carries a right of survivorship. K.S.A. 58-501 expressly provides that, when a joint tenant dies, an "affidavit of death from some responsible person who knows the facts" constitutes prima facie evidence of the death and, where real property is involved, "shall be recorded in the office of the register of deeds in the county where the land is situated." Attach a certified copy of the death certificate. Kansas imposes no real estate transfer tax and no state estate or inheritance tax.
