Plain-English Summary
The Texas Comptroller ruled that charges for repairing a residential water well pump are taxable. A taxpayer asked the Comptroller to review whether repairing a well pump used to supply water to a home was subject to sales tax.
The Comptroller's answer turned on how the pump itself is classified. Because a well pump can be easily removed from the well for repair or replacement, it is treated as tangible personal property rather than as part of the real property (the well or the home). Repair services performed on tangible personal property are taxable in Texas, so the total charge for repairing the pump — not just parts, and not just labor — is subject to tax. The letter notes this result matches an earlier Comptroller letter that had already confirmed the same policy for repairing residential well pumps.
The letter also makes a broader administrative point: the Comptroller's job is to administer the Texas Tax Code, and it does not need to weigh other state laws (such as property-classification rules that might otherwise apply to wells or water rights) when deciding how to tax a repair service.
What This Means For You
Well pump repair and service companies: If you repair, remove, or replace residential well pumps, you should charge sales tax on the full amount billed for the repair, including labor, because the pump is treated as tangible personal property rather than a fixture attached to real estate.
Homeowners with private wells: Expect sales tax to apply to invoices for well pump repair or replacement services, similar to repairs on other home equipment and appliances.
Accountants and tax professionals: This ruling is a useful data point for classifying "is it real property or tangible personal property" questions for water well equipment — the key fact the Comptroller relied on was that the pump is easily removable, not that it happens to be installed at a residence.
Q&A
Q: Why is repairing a well pump taxable instead of exempt like some real-property repairs?
A: Because the pump can be easily removed from the well for repair or replacement, the Comptroller treats it as tangible personal property rather than part of the real estate. Repairs to tangible personal property are taxable, while some services to real property are not.
Q: Does the tax apply only to parts, or to labor too?
A: The ruling states the "total charge" for repairing the well pump is taxable, meaning both parts and labor components of the repair bill are subject to tax.

Dear **:
In your letter of June 27, 1994, you asked us to review the taxability of
repairing a well pump used to provide water to a residence.
The well pump which can be easily removed for repair or replacement is
considered tangible personal property and the total charge is taxable. I have
enclosed a copy of a letter that confirms the policy of taxing the repair of
the residential well pump.
The Comptroller is responsible for administering the Texas Tax Code. Other
state laws do not have to be considered in the Comptroller's administrative
process.
The opinion is based upon the facts presented. If there are additional or
different facts, the opinion may change.
