Did a general nonprofit service organization's sales-tax exemption cover its Texas motor vehicle purchase?
Apply this to your situation
This page answers the general question as of 1992. Ezel answers yours, under current Texas tax law, with citations.
Plain-English summary
The 1992 Texas Tax Administration letter said a nonprofit service organization's limited-sales-tax exemption for office supplies and equipment did not extend to its motor vehicle purchase.
Motor vehicles were governed by a separate statute with different exemptions. Buying a vehicle to donate to a nonprofit organization was also taxable under the letter.
STAR now adds an alert that House Bill 4426 created exemptions effective September 1, 2025, for a vehicle primarily used by a qualifying nonprofit food bank for its purposes and for an entity providing housing services that primarily uses the vehicle as housing for people experiencing homelessness.
What this means for you
Nonprofit organizations
Federal or limited-sales-tax exemption does not by itself establish a Texas motor vehicle exemption.
Food banks, housing-service entities, and dealers
The newer exemptions are narrow and depend on entity type and primary vehicle use.

Dear **:
Your letter concerning the tax paid by ** on the Plymouth
van has come to my attention.
My staff has looked into the situation and it appears that tax was
properly collected. Motor vehicles are taxed under the Motor Vehicle
Sales and Use Tax Law, a separate statute with a different set
of exemptions from the Limited Sales Tax Law. The letter your
organization received in 1988 deals with limited sales tax. Your
purchases of office supplies and office equipment are covered
under limited sales tax. Your organization is exempt from tax
imposed on those purchases.
However, there is no exemption available in the motor vehicle tax
act for a nonprofit service organization such as yours. The purchase
of a motor vehicle to be donated to a nonprofit organization is also
subject to motor vehicle tax.
