Disclaimer: This is a February 13, 1968 California State Board of Equalization tax-counsel letter published by CDTFA as support for a sales and use tax annotation. It gives a short attachment-and-use test for life rafts under the watercraft exemption then described in Ruling 51.5. It does not address unattached rafts or every requirement for the underlying vessel. This summary is informational only and is not legal or tax advice.

Plain-English summary

California compared life rafts with lifeboats. A life raft qualified as an integral vessel component when it was affixed or attached to the watercraft's structure and used in that position for navigation or operation of the vessel.

The short letter did not grant a blanket exemption for every life raft. Its conclusion depended on structural attachment and vessel use.

What this means for you

Vessel operators, marine suppliers, and tax advisers

Keep evidence showing how the raft is secured to the vessel and how it serves navigation or operation. A portable or separately used raft is outside the facts this letter decided.

Common questions

Q: Were attached life rafts treated like lifeboats?

A: Yes.

Q: Was attachment to the vessel important?

A: Yes. The letter made attachment and use while attached part of its test.

Q: Did the letter decide treatment for unattached rafts?

A: No.

Gentlemen:
This is in reply to your letter of January 30, 1968
relative to liferafts coming within the exemption
provided in Ruling 51.5 for watercraft.
To qualify for an exemption, liferafts must be af
fixed or attached to the structure of the water
craft used while thus affixed or attached for navi
gation or operation of the vessel. It is our opin
ion that liferafts are analogous to lifeboats when
so affixed and become an integral part of the ves
sel qualifying for exempt status .
If you have any further questions, please feel free
to write.
Very truly yours,
