MEMORANDUM FOR: ZOLTAN BADGY, Acting Director, Federal-State Operations

FROM: H. BERRIEN ZETTLER, Deputy Director, Directorate of Compliance Programs

SUBJECT: Washington Inspection Procedures for Enforcing Excavation Standards

The Washington directive, WRD 91-2B, addressing inspection procedures for enforcing the State's excavation standards has been reviewed as requested in your March 3 memorandum. Please be advised that our review revealed that the State's directive is essentially the same as OSHA's inspection procedures for enforcing the excavation standards (CPL 2.87). We concur with the Region's determination that the inspection procedures are at least as effective as the Federal.

If we can be of any further assistance, please contact Mr. Roy Gurnham or Mr. Dale Cavanaugh of my staff at (202) 219-8136.
