Cautions
In D.O., Sanchez dissented in part because he viewed the school district’s assessment duty as independent of the parent’s full cooperation. The panel majority reached a different result on the delay.
“Our precedent is clear that the school district has an independent legal obligation to promptly assess a child for a suspected disability, even when the parent does not cooperate in full or makes promises they do not keep.”
In the Willow Project appeal, Sanchez concurred in finding agency error but dissented from the remedy of remand without vacatur.
“But I cannot join the majority’s adoption of an improper remedy—remand without vacatur—under the circumstances of this appeal.”
