Plain-English summary

After reviewing an application and consulting the Environmental Protection Agency, the IRS designated a project as a qualified green building and sustainable design project. It also allocated a limited amount of authority to issue bonds for the project. The issuer still had to meet the Code and Notice 2005-48 requirements, including certification and reporting. The IRS expressly gave no opinion on whether interest on any bonds ultimately issued would be tax exempt.

Ruling snapshot

  • Question: Would the IRS designate the project and allocate authority to issue qualified green building and sustainable design project bonds?
  • Outcome: Approved, subject to the applicable bond requirements.
  • Key authorities: IRC §§ 142(a)(14) and 142(l)(7); Notice 2005-48.
