ORDER DISMISSING PETITION FOR REVIEW
The United States Air Force petitioned the Environmental Appeals Board to review certain provisions of Hazardous Waste Management Facility Permit Number AK8 57002 8649, which U.S. Environmental Protection Agency Region 10 issued to the Air Force for Joint Base Elmendorf-Richardson. The parties later informed the Board that they had reached an agreement through the Board’s Alternative Dispute Resolution program under which the Air Force would seek dismissal of their petition following certain steps provided for in the agreement. Pursuant to the parties’ settlement agreement, the Air Force has now filed a Motion to Dismiss requesting dismissal of their petition with prejudice and represent that it is consistent with the terms of the settlement agreement. Motion to Dismiss 1 (Sept. 20, 2024). In light of the Air Force’s filing and the representations contained therein, the Environmental Appeals Board dismisses the Air Force’s petition for review.
