By motion filed on November 20, 2006, the Sierra Club, the Petitioner in the above-captioned matter, requests that the Board enter an order dismissing its petition for review. Motion to Dismiss (Nov. 20, 2006) ("Motion"). The Motion states that the parties "have reached an agreement that obviates the need for further litigation." Motion at 1.
The Motion is hereby granted and the Sierra Club's petition for review is dismissed with prejudice.
