Plain-English summary
A 2012 final decision resolving dozens of Shamokin Filler contest and penalty proceedings was stayed while the company challenged MSHA's jurisdiction over its carbon plant. After the Third Circuit affirmed jurisdiction and the Supreme Court denied review, Judge John Kent Lewis lifted the stay. He also amended the earlier order's caption to add omitted contest dockets and correct one docket number. Shamokin Filler was ordered to pay $65,736 and employee William Rosini was ordered to pay $5,164 for an individual-liability proceeding, with dismissal to follow receipt of the total $70,900.
Decision snapshot
- Governing provision: 30 U.S.C. § 820(c)
- Outcome: The caption was corrected, the jurisdictional stay was lifted, and Shamokin Filler and William Rosini were ordered to pay $65,736 and $5,164 respectively.
- Key point: Once appellate review of Mine Act jurisdiction ended, the stayed final order became enforceable and the assessed penalties became due.
