Final ARB decision
This decision is a final action of the Administrative Review Board under 29 C.F.R. § 26.1(b), which provides that the Board acts as fully and finally as the Secretary of Labor for matters within its authority. The Board dismissed John Bauche's Sarbanes-Oxley appeal after he failed to file an opening brief or otherwise comply with its notice. This final order ends the Board appeal without reviewing the whistleblower claim's merits.

Plain-English summary

John Bauche sought Board review in a Sarbanes-Oxley whistleblower case against Masimo Corporation. The Board issued a notice that it intended to dismiss the petition for review. Bauche responded, but his filing did not include the required opening brief or otherwise comply with the notice. For the reasons given in that notice, the Board dismissed the appeal without reaching the underlying claim.
