Panama Canal Commission (FLRA 6-DR-60001): Review application dismissed for missing information
Apply this precedent to your situation
This is citable Authority precedent from 1988, and it may have been appealed since. Ezel checks how it stands today and answers your situation, with citations.
Final FLRA representation decision. The Authority dismisses the petitioner's application for review after he failed to supply information required by its procedural rules. The short published order does not describe the underlying regional ruling, so it does not establish whether the judicial-review exclusion for appropriate-unit determinations in 5 U.S.C. § 7123(a)(2) applies.
Plain-English summary
Eugenio L. Morice applied for Authority review in a case involving the Panama Canal Commission's Republic of Panama activity. The Authority found the application incomplete under its representation case procedures and gave him until October 17, 1988, to provide the missing information. It warned that failure to comply could lead to dismissal. He did not provide the requested documentation, so the Authority dismissed the application. The order gives no details about the regional ruling or the underlying representation issue.
