ECAB final decision dismissing appeal. The Board dismissed the appeal because OWCP's decision was void while the same issue was pending before the Board. Under 20 C.F.R. § 501.6(d), this order becomes final 30 days after issuance. A party may petition the Board for reconsideration within 30 days unless this order specifies another period, under 20 C.F.R. § 501.7(a).

Plain-English summary

A postal worker appealed OWCP's reconsideration denial concerning an impairment award. The Board found the same underlying issue was already before it when OWCP issued that decision, so OWCP had no concurrent authority to decide it. With the OWCP decision void, the Board dismissed the appeal for lack of a reviewable decision.

Decision snapshot

  • Authority: 20 C.F.R. §§ 501.3, 501.6(d), 501.7(a).
  • Outcome: Appeal dismissed because the OWCP decision was void.
  • Key point: OWCP and the Board could not decide the same issue simultaneously.

ORDER DISMISSING APPEAL

Before:
ALEC J. KOROMILAS, Chief Judge
PATRICIA H. FITZGERALD, Deputy Chief Judge JANICE B. ASKIN, Judge

On May 6, 2024, appellant filed a timely appeal from a November 7, 2023 nonmerit decision of the Office of Workers’ Compensation Programs (OWCP). The Clerk of the Appellate Boards assigned the appeal Docket No. 25-0257.

The Board, having duly considered this matter, notes that the Board and OWCP may not simultaneously exercise jurisdiction over the same issue(s) in a case on appeal. 1 By the November 7, 2023 nonmerit decision, OWCP denied appellant’s September 22, 2023 request for reconsideration, finding that it was untimely filed and failed to demonstrate clear evidence of error. However, on October 24, 2022, appellant had timely filed a petition for reconsideration of the Board’s September 21, 2022 decision regarding the same underlying merit issue.2 As the same

As OWCP’s November 7, 2023 decision is null and void, there is no final adverse decision issued by OWCP over which the Board may properly exercise jurisdiction. The Board, therefore, concludes that the appeal docketed as No. 25-0257 must be dismissed. Accordingly,

IT IS HEREBY ORDERED THAT Docket No. 25-0257 is dismissed.
