Apply this precedent to your situation
This is citable Board precedent from 2024, and it may have been appealed since. Ezel checks how it stands today and answers your situation, with citations.
ECAB final decision. The Board dismissed the appeal because OWCP acted while the same issue was pending before the Board. This dismissal ends the Board appeal; it does not decide the underlying compensation claim. Under 20 C.F.R. § 501.6(d), Board decisions and orders become final after 30 days. A party may petition the Board for reconsideration within 30 days unless the order specifies another period, under 20 C.F.R. § 501.7(a).
Plain-English summary
A Veterans Affairs worker appealed an OWCP decision denying reconsideration of a mold-exposure claim. The Board found that the same underlying issue was already pending in another Board appeal when OWCP issued that decision. OWCP lacked concurrent jurisdiction, making its decision null and void. With no valid adverse OWCP decision to review, the Board dismissed this appeal.
Decision snapshot
- Authority: Federal Employees' Compensation Act, 5 U.S.C. § 8101 et seq.
- Outcome: Appeal dismissed; OWCP reconsideration decision was null and void.
- Key point: OWCP cannot decide the same issue while it is pending before the Board.

ORDER DISMISSING APPEAL

On May 31, 2023 appellant filed a timely appeal from a May 17, 2023 decision of the Office of Workers’ Compensation Programs (OWCP). The Clerk of the Appellate Boards assigned the appeal Docket No. 23-0923.
The Board, having duly considered this matter, notes that the Board and OWCP may not simultaneously exercise jurisdiction over the same issue(s) in a case on appeal. 1 By the May 17, 2023 decision, OWCP denied appellant’s April 26, 2023 request for reconsideration, finding that it was untimely filed and failed to demonstrate clear evidence of error. However, on March 8, 2022, appellant had filed an appeal with the Board from a March 3, 2022 decision, regarding the same underlying merit issue, to which the Clerk of the Appellate Boards assigned Docket No. 22-0565. As the same underlying issue of whether appellant had established a compensable

As OWCP’s May 17, 2023 decision is null and void, there is no final adverse decision issued by OWCP over which the Board may properly exercise jurisdiction. The Board, therefore, concludes that the appeal docketed as No. 23-0923 must be dismissed. Accordingly,
IT IS HEREBY ORDERED THAT Docket No. 23-0923 is dismissed.
