ECAB final decision. The Board dismissed W.W.'s appeal because the case record contained no final adverse OWCP decision issued within the 180-day period over which the Board could exercise jurisdiction. It did not review the underlying compensation matter. Under 20 C.F.R. § 501.6(d), Board decisions and orders become final after 30 days. A party may petition the Board for reconsideration within 30 days unless this order specifies another period, under 20 C.F.R. § 501.7(a).

Plain-English summary

W.W. sought Board review of what he described as an April 2023 OWCP decision. The record sent to the Board contained no final adverse OWCP decision from the relevant 180-day period. Without a reviewable decision, the Board had no jurisdiction to hear the appeal. It dismissed the proceeding without reaching the underlying claim.

Decision snapshot

  • Authority: Board jurisdiction over final OWCP decisions under 20 C.F.R. § 501.3(e).
  • Outcome: Appeal dismissed for lack of a reviewable final OWCP decision.
  • Key point: A Board appeal requires a final adverse OWCP decision in the applicable review window.
