ECAB final decision. The Board dismissed docket 21-0026 because it duplicated a prior appeal of the same OWCP decision. The prior docket, 20-1595, had already been decided. A party may petition the Board for reconsideration within 30 days of issuance unless this decision specifies another period, under 20 C.F.R. § 501.7(a). FECA compensation decisions are generally not subject to court review under 5 U.S.C. § 8128(b).
Plain-English summary
J.A. filed two appeals from the same April 15, 2020 OWCP decision, and the clerk assigned separate dockets. The Board found the second docket unnecessary and dismissed it. It noted that the first appeal, docket 20-1595, had already resulted in an April 2021 Board decision. This order did not reconsider that earlier decision.
