ECAB final decision. The Board set aside OWCP’s March 22, 2010 wage-earning capacity decision and remanded the case because OWCP did not properly issue that decision to the claimant’s authorized representative. Under 20 C.F.R. § 501.6(d), this Board decision becomes final 30 days after issuance unless the Board fixed a different period in it. A party may petition the Board for reconsideration within 30 days unless this decision specifies another period, under 20 C.F.R. § 501.7(a).
Plain-English summary
R.W., a postal letter carrier with an accepted left tibia fracture, appealed an OWCP decision that reduced his wage-loss compensation based on actual earnings. OWCP mailed the decision to him and his employer, but the record did not show that it mailed a copy to his authorized representative. The Board held that this failed the notice requirement in 20 C.F.R. § 10.127. It set aside the reduction decision and remanded the case for appropriate action.
