Final FLRA decision. The Authority dismisses the union's negotiability petition because it did not respond to an order to correct deficiencies. An aggrieved person may seek judicial review by filing a petition in an appropriate United States court of appeals within 60 days after issuance under 5 U.S.C. § 7123(a).

Plain-English summary

AFGE Local 1164 filed a negotiability petition involving the Social Security Administration's Boston region. The Authority identified defects in the filing and ordered the union to correct them by February 8, 1989. It warned that failure to comply could lead to dismissal. The union did not respond, so the Authority dismissed the petition. The short published order does not identify the proposals or decide whether they were negotiable.

Decision snapshot

  • Authority: Deficient negotiability petitions under 5 C.F.R. § 2424.4(c)(1).
  • Outcome: Union's petition dismissed for failure to correct deficiencies.
  • Key point: The Authority ended review after the union did not answer its correction order.
