Plain-English summary

Louisiana's Commissioner of Elections submitted a Parish Board of Election Supervisors training PowerPoint for expedited Attorney General review. The office found one needed change before the presentation would comply with state law: slide 32's quotation about election challenges did not reflect Act 321 of the 2024 regular session.

The opinion directed an update to that slide and described the edits as minor. It did not reproduce the PowerPoint or supply the corrected slide text. Its approval was therefore conditional on incorporating the new law into the challenge discussion.

What this means for you

Parish election supervisor training staff

The opinion identifies slide 32 of the submitted presentation as needing an update to reflect Act 321. It says the form would comply after the correction, rather than approving the old wording as submitted.

Readers researching challenge procedures

The opinion flags a change to the law discussed in the training material but does not set out the amended challenge procedure. The presentation and Act 321 would be needed for that detail.

Common questions

Q: Was the election supervisor PowerPoint approved without edits?
A: No. The AG required slide 32's quoted challenge provision to be updated for Act 321 of 2024.

Q: Does the opinion say what the new challenge rule requires?
A: No. It identifies an outdated quotation but does not reproduce the amendment or the corrected slide.

Background and statutory framework

The opinion cited La. R.S. 18:423 as requiring Attorney General approval of the training form. Its only identified problem was the mismatch between the slide 32 quotation and the changes made by Act 321 in the 2024 legislative session.

Dear Commissioner Hadskey:

We received your request for expedited review and approval from our office of the Parish Board of Election Supervisors Training PowerPoint.
The Attorney General’s approval of this form is required by La R.S. 18:423. We have reviewed the document, and it is the opinion of this office that once the following minor corrections are made, the form will be compliant with Louisiana law.
Page 32 of the Powerpoint discusses challenges and references La. R.S. 18: 131 5(C).
However the quoted text in the PowerPoint does not reflect the changes made by Act 321 of the 2024 Regular Legislature Session. Please update this slide to reflect same.
We hope that this opinion has adequately addressed the legal issues you have raised. If our office can be of any further assistance, please do not hesitate to contact us.

With best regards,

LIZ MURRILL
