Can a full-time Louisiana probation officer work part-time as a sheriff's deputy or municipal police officer?

Short answer Yes under the dual-officeholding statute examined. The attorney general said a full-time state probation officer could also serve in the four described part-time deputy or police roles. It treated unpaid municipal reserve police service as outside that statute's employment definition and left ethics questions open.

Plain-English summary

A full-time probation officer with Louisiana's Department of Public Safety and Corrections asked whether he could also serve part-time as a sheriff's deputy, reserve deputy, municipal police officer, or reserve police officer. The attorney general said the Dual Officeholding and Dual Employment Law did not prohibit the combinations described.

The state probation job counted as full-time employment. The part-time deputy and reserve deputy roles counted as part-time appointive offices, while part-time municipal police work counted as employment. The office said unpaid municipal reserve police service did not fall within the law's compensated-employment definition. La. R.S. 42:63(E) barred holding a second full-time government office or job, but the additional positions described were part-time or unpaid. The opinion did not decide any separate Ethics Code issue.

What this means for you

State probation officers

The opinion permitted a full-time probation officer to serve in each of the described part-time deputy or municipal police roles under the dual-officeholding law. Its answer depended on those additional roles being part-time or, for municipal reserve service, unpaid.

Sheriff and police departments

The office classified part-time deputies as part-time appointive officers and part-time municipal officers as part-time employees. It did not treat either as a prohibited second full-time government position in the fact pattern presented.

Reserve police volunteers

The opinion said an unpaid part-time municipal reserve police officer was outside the dual-officeholding law's employment definition because the role received no salary or per diem. It did not resolve other rules that might govern reserve service.

Common questions

Q: Can a Louisiana probation officer also be a part-time deputy sheriff?
A: The attorney general said yes under the dual-officeholding provision it analyzed, for both a part-time deputy and a part-time reserve deputy role.

Q: Can the officer also work part-time for a municipal police department?
A: Yes under the provision examined. The opinion classified that police role as part-time employment, not a second full-time position.

Q: Does unpaid municipal reserve police service count as employment under this law?
A: The opinion said no for the unpaid role described, because the statutory definition depended on salary or per diem compensation.

Q: Did the opinion decide whether any of these combinations raise ethics issues?
A: No. It referred possible Louisiana Code of Governmental Ethics questions to the state Board of Ethics.

Background and statutory framework

The opinion classified the probation job in state government and the sheriff and municipal positions in separate political subdivisions. La. R.S. 13:5537 supported the sheriff's authority to appoint deputies. La. R.S. 42:63(E) prohibited a person with a full-time government job or office from also holding another full-time government job or office. The office concluded that the requested part-time roles did not trigger that prohibition, and it separately excluded unpaid municipal reserve service from the compensated-employment definition.
