Could Lockport's volunteer fire chief also sit on the Lafourche Parish Council?
Apply this to your situation
This page answers the general question as of 2015. Ask about yours and see what current Louisiana law means for your facts, with citations you can check.
Plain-English summary
The Lafourche Parish district attorney asked whether a fire chief could serve on the parish council. The request concerned the Lockport Volunteer Fire Company, not the parish fire protection district. In December 2015, the Attorney General concluded that its volunteer chief was not barred from holding the council seat by Louisiana's dual officeholding law.
The opinion relied on the facts that the chief was an unpaid volunteer chosen by the company's volunteers and that the company received no public funds or fire-service contract from the district described in the request. The AG treated the council seat as the only public office among the two roles. It said its answer did not resolve any issue under the governmental ethics code.
Currency note
This opinion was issued in 2015. Subsequent statutory amendments, court decisions, or later AG opinions may have changed the analysis. Treat this page as historical context, not current legal advice. Verify current law before relying on any specific rule, deadline, or remedy mentioned here.
Common questions
Did the AG decide the same question for a fire protection district chief?
No. The request clarified that the person was chief of the Lockport Volunteer Fire Company rather than of Lafourche Parish Fire Protection District No. 2.
Why did the dual officeholding restriction not apply?
The AG said the fire-company volunteer role was not a public office or public job on the facts given. The parish council seat was the only public office.
Had the chief already begun serving on the council?
The opinion's footnote said he had been elected but had not taken the council oath, so the two roles were not yet held at the same time.
Did the opinion resolve an ethics conflict?
No. It referred governmental ethics questions to the Louisiana State Board of Ethics.
Background and statutory framework
The opinion classified the volunteer-company role and the parish council seat before applying the dual officeholding law. It distinguished the volunteer company from the fire protection district and confined its conclusion to the arrangement described in the request.

OPINION 15-0185
Honorable Camille A. Morvant, II
78 Dual Officeholding
District Attorney
La. RS. 42:61 et seq.
Lafourche Parish
The provisions of the Dual Officeholding and Dual Employment Law
P.O. Box 451
do not prohibit the Fire Chief for the Lockport Volunteer Fire
Thibodaux LA 70302
Company from holding the office of Council Member for the
Lafourche Parish Council.
Dear Mr. Morvant:
Our office received your request for an opinion indicating a concern has been raised about the Fire Chief for the Lafourche Parish Fire Protection District NO.2 serving as Council Member for the Lafourche Parish Council ("Council"). However, you have indicated that the position in question With you is the Fire Chief of the Lockport Volunteer Fire Company ("Company") not the Lafourche Parish Fire Protection District No. 2. We understand the Fire Chief is a volunteer and does not receive a salary from the Company or the Lafourche Parish Fire Protection District NO.2. Additionally, the Company does not receive public funds nor does the Company have a contract with the Lafourche Parish Fire Protection District NO.2 to provide fire protection services.
The provisions of the Dual Officeholding and Dual Employment Law, found at La. R.S.
42:61 et seq., govern questions concerning the ability to hold two or more public offices and/or positions simultaneously. 1 Classifying the correct nature of the positions held is essential for the purposes of applying the Dual Officeholding provisions.
According to the information provided to our office, the Company is comprised of volunteer firemen. The Fire Chief for the Company is elected by the volunteer firemen of the Company. Our office has consistently opined that the provisions of the Dual Officeholding and Dual Employment Law are not applicable to volunteer firernen.?
Therefore, the provisions of the Dual Officeholding and Dual Employment Law do not apply to a volunteer fireman who serves as Fire Chief for the Company.
1 Your request notes that the Fire Chief has been recently elected and has not taken his oath of office as Member and therefore, not currently holding both positions at the same time. The Dual Officeholding and Dual Employment Law is applicable only when muJtiple public positions are held simultaneously.

The Parish of Lafourche ("Parish") is a local governmental subdivision operating under a home rule charter under the authority of La. Const. art. VI, § 5. ..'
According to the information provided to our office, the Company.does not receive public funds from the Council nor does the Company have a contract with the Council to provide services to the Council.
The provisions of the Dual Officeholding and Employment Laws are only applicable to positions of public office or public jobs." As the position of Council Member is the only position of public office, the provisions of the Dual Officeholding and Employment Laws are not applicable to the two positions of concern.
Based on the applicable provisions of law, our prior opinions and the information you provided, it is the opinion of this office that the Fire Chief for the Lockport Volunteer Fire Company is not prohibited by the Dual Officeholding provisions from holding the office of Council Member for the Lafourche Parish Council.
Please note that our expressed opinion is limited to an examination of the state law relating to Dual Officeholding. Further, it does not address the potential applicability of the provisions of the Louisiana Code of Governmental Ethics, La. R.S. 42:1111 et seq.
