Could a Louisiana state senator also serve part time as Lafayette's parks and recreation director?

Short answer The AG said the dual officeholding law did not prohibit a state senator from also holding Lafayette's parks and recreation directorship if that appointive post was part time. It said the full-time version would fall under the statutory prohibition and left ethics questions to the State Board of Ethics.

Plain-English summary

Senator-elect Gerald Boudreaux asked whether he could keep his Lafayette City-Parish parks and recreation directorship after taking office. He held the director position full time but proposed continuing part time. In December 2015, the Attorney General concluded that the part-time appointive directorship was not prohibited alongside the state Senate office by the dual officeholding provision it examined.

The AG classified the Senate seat as a part-time elective state office and, on the request's part-time assumption, the directorship as a part-time appointive local office. It explained that the cited prohibition reached a state elected official's simultaneous full-time appointive local office, so the proposed part-time arrangement fell outside it. The opinion expressly confined itself to dual officeholding law and did not decide government ethics questions.

Currency note

This opinion was issued in 2015. Subsequent statutory amendments, court decisions, or later AG opinions may have changed the analysis. Treat this page as historical context, not current legal advice. Verify current law before relying on any specific rule, deadline, or remedy mentioned here.

Common questions

Did the opinion approve keeping the director job full time?

No. The AG analyzed the proposed part-time directorship and said the statutory bar applied to a full-time appointive office in a political subdivision.

Was Boudreaux already holding both offices?

The opinion's footnote said he had been elected but had not taken the Senate oath, so he did not yet hold the two positions simultaneously.

Did the AG decide whether the arrangement met ethics rules?

No. It said advisory rulings under the governmental ethics code belonged to the Louisiana State Board of Ethics.

Background and statutory framework

The opinion turned on how Louisiana's dual officeholding law classified each role. It treated Lafayette City-Parish as a political subdivision, the director as an appointed office established by local ordinance, and the Senate seat as an elective state office. The answer depended on the director post actually being part time.

Mr. Gerald Boudreaux

Senator-Elect

District 23
The provisions of the Dual Officeholding and Dual Employment Law
P.O. Box 91245
do not prohibit a State Senator from holding the part time appointive
Lafayette, LA 70509
office of Director for the Parks and Recreation Department for the
LafayetteParish City Parish Consolidated Government.

Dear Mr.Boudreaux:

Our office received your request for an opinion regarding whether you may hold the office of State Senator for District 23 and maintain your position as the Director for the Parks and Recreation Department ("Department") for the Lafayette Parish City Parish Consolidated Government. While we understand that your position as director is currently full tirne, you have indicated that you wish to continue on a part tirne basis.
Thus you have asked us whether the Dual Officeholding and Ernployment Law prohibit you from sirnultaneously holding positions of part tirne Director for the Departrnent and State Senator.

The provisions of the Dual Officeholding and Ernployment Law, found at La. R.S. 42:61 et seq., govern questions concerning the ability to hold two or more public offices and/or positions simultaneously.' Classifying the correct nature of the positions held is essential for the purposes of applying the dual officeholding provisions.

The Lafayette Parish City Parish Consolidated Government ("City Parish") is a local governmental subdivision operating under a horne rule charter under the authority of La.
Const. art. VI, § 5. The City Parish is considered a separate political subdivision of the state for the purposes of the Dual Officeholding laws." The Departrnent is under the direction and supervision of the President for the City Parish ("President,,).3 The position of Director for the Departrnent is an office which is specifically established by the

1 Your request notes that you have been recently elected and have not taken your oath of office as Senator and therefore, not currently holding both positions at the same time. The Dual Officeholding and Dual Employment Law is applicable only when multiple public positions are held simultaneously.
2 "Political subdivision" means a parish, municipality, and any other unit of local government, including a school board and a special district, authorized by law to perform governmental functions. La. R.S.

ordinances of the City Parish and filled by appointment by the President who is an elected public official." Based on the assumption that the position is part time, the position of Director for the Department is classified as a "part time" "appointive office" for purposes of the Dual Officeholding Laws."

The legislative branch of state government includes members of the Senate." The position of State Senate is classified as a "part time" "elective office" for the purposes of the Dual Officeholding Laws.'

The most applicable provision of the Dual Officeholding and Dual Employment Law is La. R.S. 42:63(C), which provides in pertinent part:

No person holding an elective office in the government of the state shall at the same time hold another elective office, a full-time appointive office, or employment in the government of this state or in the government of a political subdivision thereof.

La. R.S. 42:63(C) prohibits the simultaneously holding of an elected office in the government of the state and a full time appointive office in the government of a political subdivision. Our office has consistently opined that a state legislator is prohibited by the Dual Officeholding provisions from holding a full time appointive office in a political subdivision of the state." However, since the position of Director for the Department is a part time appointive office, the prohibition of La. R.S. 42:63(C) is not applicable.

Based on the applicable provisions of law, our prior opinions and the information you provided, it is the opinion of this office that a State Senator is not prohibited by the Dual Officeholding provisions from holding the part time appointive office of Director for the
