THE FOUR QUALIFYING CRITERIA FOR WITHDRAWAL UNDER IRC 6323(j)

The IRS may withdraw a Notice of Federal Tax Lien only if one or more of the following conditions are met:

Criterion 1: Premature or Improper Filing

The NFTL was filed before IRS procedures were properly followed, including:

- Minimum three consecutive successful electronic payments processed

Criterion 3: Facilitates Collection

Withdrawal would help the IRS collect the tax owed, such as:

With consent of the National Taxpayer Advocate or upon recommendation, withdrawal serves the best interest of both parties. Examples include:
- Lien severely impacts taxpayer's ability to earn income
